Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a.At Terminal 4, Port Everglades, FL. An employee was operating a powered industrial truck without wearing a seat belt, which exposed the employee to caught by/in between hazards, on or about 9/25/2009. Among the feasible and useful methods to correct the hazard is prohibit employees from driving this type of equipment without wearing the seat belt.
