Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)On the 3rd floor roof of the Omphoy Ocean Resort located at 2842 South Ocean Boulevard in Palm Beach, Florida: An employee gaining access to the third floor roof by climbing onto the side and down a 24 ft. fiberglass extension ladder did not have that ladder secured to the structure to prevent sideways motion, on or about December 18, 2009. Among other methods of abatement, one feasible and acceptable means of abatement to correct this hazard is to ensure that the ladder is secured to prevent accidental displacement.
