Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fractures and crushing injuries due to the roll-over and/or collision of powered industrial trucks: Production Area - The seat belt was not worn by an employee operating the G25E Daewoo forklift on or adjacent to uneven surfaces, within the cutting and packaging inside the plant, and near vehicular traffic outside the facility. Seat belts in forklifts are a component of an operator restraint system that is designed to reduce the incidence and severity of injuries to the operator in the event of a roll-over accident. Among other methods, one feasible and acceptable method to abate this item is to ensure that all powered industrial trucks are equipped with seat belts and employees are required to use them.red
