Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: While conducting masonry construction related activities, an employee was exposed to struck by hazards associated with climbing from the operations station of a Bobcat 873 Skid Steer Loader while the bucket was elevated. Among other feasible and acceptable method to correct this hazard is to follow the guidelines in the Association of Equipment Manufacturers manual for skid-steer loaders which states: "Never leave the operator's seat without lowering the bucket or other attachment flat on the ground or engaging the approved lift arm support and then stopping the engine and removing the ignition key."

Among other feasible and acceptable method to correct this hazard is to follow the guidelines in the Association of Equipment Manufacturers manual for skid-steer loaders which states: "Never use the bucket, forks or other attachments for a work platform or personnel carrier."
