Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment that were free from
recognized hazards and were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to struck-by and/or crushing hazards.  A qualified person was not
inspecting and
maintaining the Challenger and Hunter automotive lifts in accordance with
the manufacturer's
recommendations.  Among other methods, one feasible and acceptable means
of abatement
would be to adhere to the requirements of ANSI/ALI ALOIM-2008 titled
Safety Standard for
Automotive Lifts-Safety Requirements for Operation, Inspection, and
Maintenance:
Section 5.1 requires that the employer establish a periodic inspection
procedure in accordance
with the lift manufacturer in order to ensure reliability and allow the
continued safe operation
of the lift.
Section 6.1.1 requires the employer to establish a periodic planned
maintenance procedure in
accordance with the recommendations of the lift manufacturer in order to
ensure reliability and
allow the continued safe operation of the lift.
