General-duty citation text

Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
caused or were likely to cause death or serious physical harm.  Employees
were exposed to the
hazards associated with dust explosion, deflagration or other fire hazards
at
Milk Specialties, 6128 Old Borden Road in Boscobel WI, on or about March
1, 2011,
a) The agglomuation cyclones and Hi Fat cyclones did not have explosion
protective devices or
isolation protective devices.
b) The Whey (#100, #132, #106, #126, #119, #113) and Agglomulator storage
bins (#144,
#154, #149, #159), located inside the building, did not have explosion
protective devices
c) The bucket elevators did not have explosion protective devices
d) The drag conveyors did not have sensing devices to automatically
deactivate if they were to
become jammed.
e) The pneumatic conveyor couplings were not bonded.
Among other methods, some feasible means of abatement are to comply with
the National Fire
Protection Association (NFPA) 61 Standard for the Prevention of Fires and
Dust Explosion in
Agriculture and Food Processing Facilities, 2008 edition, 6.1 Explosion
prevention, relief and
venting, as used in this standard shall encompass the design and
installation of devices and
systems to vent the gases and over pressure resulting from a combustion
explosion so that
damaged is minimized.  6.3.1 Equipment requiring explosion prevention
shall be protected by
containment, suppression, inerting, or explosion venting. 7.3.3 Conveyors,
screw, drag or en-
masse conveyors shall be fully enclosed in metal housings and shall be
designed to either relieve
or stop if the discharge end becomes plugged. 7.4.3.3 Legs or portions of
legs
that are located
inside shall have the maximum practicable explosion relief area through
the roof directly to the
out side. 10.4.10.1 Dust bins and Tanks:  bins and tanks for the storage
of grain dust shall be
dust tight, constructed of non combustible material and located outside
the building or structure.
13.4 Static electricity shall be dissipated by using bonding and grounding.

ABATEMENT DOCUMENTATION REQUIRED PER 29 CFR 1903.19(d)
Abatement Schedule:
Step 1-A combination of administrative controls shall be implemented as an
interim protective
measure until feasible engineering and administrative controls can be
permanently
implemented.
Step 2-A written detailed plan of abatement shall be submitted to the Area
Director outlining a
schedule for the implementation of engineering and/or administrative
measures
to control employee exposure to the hazardous condition as referenced in
thiscitation.  This plan shall include, at a minimum, target dates for the
following
actions which must be consistent with the abatement dates required by this
citation:
1)Evaluation of engineering/administrative control options
2)Selection of optimum control methods and completion of design
3)Procurement, installation, and operation of selected control measures
4)Testing and acceptance or modification/redesign of controls;
All proposed control measures shall be approved for each particular use by
a competent certified
safety professional, professional engineer, or other technically qualified
person
Step 3-Abatement shall have been completed by the implementation of
feasible engineering and
administrative controls upon verification of their effectiveness in
achieving
compliance.
