General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential atmospheric and/or toxic gas hazards: On May 6, 2009, and times prior thereto, at the 4200 block of Aaron Street, employees entered into a sewer lift station, which had not been adequately plugged at the in-coming pipeline, to perform work. Employees performed work, such as, but not limited to: a.pump removal; b.installation of inflatable sewer line plugs; and, c.manual removal of raw sewage solids. The employer did not provide the employees with, but not limited to: a.a confined space permit system; b.an operable gas meter; c.an acceptable means of rescue. Among other methods, a recognized and feasible means of abatement to correct this hazard includes, but is not limited to, the full implementation of the elements required by the American National Standards Institute (ANSI) standards Z117.1 (Safety Requirements for Confined Spaces).
