Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing, or likely to cause, death or serious physical harm to employees in that employees were exposed to a fall hazards with forklift personnel baskets being used for maintenance work: On or about May 7, 2009, and at other times prior thereto, at this warehouse site, employees performing work at ceiling heights including, but not limited to, section sign cleaning and installation were working from forklift personnel baskets that did not meet requirements listed in the ANSI B56.1 (2005) - "Safety Standard for Low Lift and High Lift Trucks" (see Paragraphs 4.17.2, 4.17.3, 7.36.3 among others). Among others, one feasible and acceptable means to abate the hazard is to provide and ensure the use of a temporary work platform that is equipped with compliant guardrails and secured to the frame of the forklift involved.
