Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: (a)On or about 05/20/09 - 22916 Highway 75, Sylvania, AL, employees were exposed to struck-by hazards created by moving vehicles where a spotter was not used when the back-up alarm for the equipment did not operate. Among other methods, feasible and acceptable methods to correct this hazard are to; a) Install an audible back-up alarm that is distinguishable from other horn signals and can be heard above surrounding noise level; b) Always use a spotter/observer when clear rear view is not possible; c) Install barriers to prevent pedestrian travel in areas where trucks are operating; d) Provide and require the use of reflective vests and/or clothing for employees who walk in the parking lot in order to make the employees more visible to heavy equipment operators.
