Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to struck-by hazards from being ejected from the forklift
during tight turns or
being crushed-by the forklift in the event of roll over:
(a)On or about 6/19/09 - in the production areas, employee(s) were observed
operating a Nissan forklift were not using the restraint device.
Among other methods, one feasible method is to comply with the
requirements of the
American Society of Mechanical Engineers document ASME B56.1-1993; Safety
Standard for Low Lifts and High Lift Trucks, Section 7.39 Operator
Restraint Devices.t
