North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: a)repair shop, three two-post hydraulic automobile lifts had been modified without the written permission of the lift manufacturer. The safety devices on the Bishamon lifts, model AB-1087, had been removed. Among other methods, one feasible and acceptable method to abate this hazard is to replace the safety devices which had been removed.
