employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees in that employees were exposed
to being struck by vehicular
traffic:
a.On or about May 11, 2009, an employee crossing the Southbound lane of
I-77 while carrying
equipment such as a ladder and empty 55 gallon drum was not protected from
oncoming traffic
through the use of high visibility apparel such as class 2, ANSI/ISEA
107-2004 compliant safety vests.
ABATEMENT NOTE:  Among other methods, one feasible and acceptable
abatement method to
correct this hazard would be to follow Chapter 6D Pedestrian and Worker
Safety as delineated in the
Manual on Uniform Traffic Control Devices, 2003 edition (Section 6D.03B
Worker Safety Apparel)
and use high visibility apparel such as vests that meet ANSI/ISEA 107-2004
Standard for High-
Visibility Safety Apparel and Headgear for risk exposure Class 2 or 3.
