Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees in that employees were exposed
to:
a.  On or about June 4, 2009, at the above addressed jobsite, an employee
was observed standing on the
edges of the skid steer bucket in order to reach the soffet of the roof.
The employee was installing
flashing on the soffett.  The employee was also observed riding in the
bucket when the skid steer was
moved.  Employee was exposed to a 12 foot fall to the ground.  No means of
fall protection was
utilized.  The Association of Equipment Manufacturers (AEM) recognizes
this practice as a hazard as
does the Manufacturer of the skid steer.  The employer stated that he had
a scissor lift on the site,
however, due to the terrain being unlevel, it was difficult to use because
it would shut off when it
reached each location for the flashing trim to be installed.  A safer
means of pulling the scissor lift
straight in instead of sideways was discussed or the use of a ladder to
install the trim.
