Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the following:
a.Employees using the freight elevator (Vertical Reciprocating Conveyor
(VRC) in the East
Plant Processing Blend Tower, bunker 9, were exposed to a fall hazard when
the door
opened without the car being present due to the interlock devices on the
doors
malfunctioning.  On or about December 31, 2009, an employee was fatally
injured when
they fell down the conveyor shaft from the fourth floor to the bottom of
the shaft.
Among the feasible means of abatement that can be used to correct this are:
One method of abatement is repairing  the interlock devices so that the
doors cannot be
opened unless the conveyor car was at that level as required by ASME
Standard for
Conveyors and Related Equipment, ASME B-20.1-2009, paragraph 6.21.2, and
PFLOW
