Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the following: a. On or about April 13, 2010, at the Columbus Commons jobsite located at Town and Third Street, the operator of the concrete pump truck did not ensure the outriggers on the truck were placed on stable ground thereby exposing employees operating the hose/boom to a struck by hazard when the left front outrigger sank into the ground causing the truck to tip and the boom to drop.
