Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by rolling nursery trailers: a.)Nursery Grounds - Employees were riding on the trailers that were used to transport plants and other equipment and were not provided with a safe place to sit, on or about April 14, 2009. Among other methods, one feasible and acceptable abatement method to correct this hazard is to fabricate a place for employees to ride that had seats, foot rests and hand holds and which would prevent them from falling off the wagon; or prevent employees from riding on the wagons.
