Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to asphyxiation and fall hazards when working from on top of a dual hopper bottom trailer: (a)Grain unloading area; A driver was observed standing on top of a Wilson Trailer Company 48' dual hopper bottom trailer. The driver had climbed up on the trailer to help promote the flow of the trailer contents through the hopper gate. Abatement certification and documentation are required for this item. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE MEANS OF ABATEMENT WOULD BE TO COMPLY WITH THE WILSON TRAILER COMPANY WARNINGS MOUNTED ON THE REAR OF THE TRAILER WHICH READ "WARNING: USE CAUTION WHEN CLIMBING ON TRAILER. NEVER ENTER HOPPER INTERIORS OR CLIMB ON TOP OF TRAILER OR LOADED COMMODITY. SERIOUS INJURY OR DEATH MAY RESULT IF YOU FAIL TO OBSERVE THIS WARNING".
