Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards from skid steers being operated by inadequately trained employees: (a)Throughout the facility; All employees who operated Case skid steers had not been provided adequate training and instruction. A vertical wood door frame member at the South end of the North/South barn had been substantially damaged by an employee operated skid steer. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE MEANS OF ABATEMENT WOULD BE TO FOLLOW MANUFACTURER RECOMMENDATIONS WITH THE OPERATOR MANUALS WHICH STATED; "IMPROPER OPERATION OF THIS MACHINE CAN CAUSE DEATH OR SERIOUS INJURY. MAKE CERTAIN THAT EVERY OPERATOR IS INSTRUCTED IN THE SAFE AND PROPER USE OF THE MACHINE, READS AND UNDERSTANDS THE MANUAL(S) PERTAINING TO THE MACHINE" AND "USE ONLY TRAINED OPERATORS WHO HAVE DEMONSTRATED THE ABILITY TO OPERATE AND SERVICE THIS MACHINE CORRECTLY AND SAFELY". Abatement certification and documentation are required for this item.
