Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to potential injury in the event of a powered industrial truck tipover: (a) PRODUCTION AREA -- OPERATOR(S) OF A CLARK FORKLIFT TRUCK, MODEL EC500-530, SERIAL #E235-225-6705FB, WERE OPERATING THIS VEHICLE WITHOUT THE USE OF A SEAT BELT, EXPOSING SAID EMPLOYEE(S) TO THE RISK OF ENTRAPMENT OF THE OPERATOR'S HEAD AND/OR TORSO BETWEEN THE TRUCK AND GROUND IN THE EVENT OF A TIPOVER. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD WOULD BE TO RETROFIT THIS FORKLIFT WITH A RESTRAINT DEVICE, SYSTEM, OR ENCLOSURE THAT IS INTENDED TO ASSIST THE OPERATOR IN REDUCING THE RISK OF ENTRAPMENT OF THE OPERATOR'S HEAD AND/OR TORSO BETWEEN THE TRUCK AND GROUND IN THE EVENT OF A TIPOVER AS EVIDENCED BY NATIONAL CONSENSUS STANDARD ANSI/ITSDF B56.1-2005, SAFETY STANDARD FOR LOW LIFT AND HIGH LIFT TRUCKS, SECTION 7.41 OPERATOR RESTRAINT SYSTEMS.
