Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to possible crushing injuries. On or about 08/30/10 an employee operating a Nissan 30-LP fork truck was not wearing a seat belt. The employee fell from the fork truck while reaching to retrieve an object near it. One feasible and acceptable abatement method to correct this hazard is to require fork truck operators to wear seat belts. Specific abatement documentation demonstrating that abatement is complete must be provided in accordance with 29 CFR 1903.19(d) (1) within 10 days after the abatement date.ment
