Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm in that
employees were exposed
to crushing hazards.
At the site:
Company Owner/President is the sole operator of the Trail King Dump
Trailer and only
employee in the incorporated company with a CDL.  During a sand dumping
operation in the
company yard during a cold and windy day with wind gusts up to thirty
miles per hour, the
trailer and truck tipped over, pinning the operator under the cab.  A
feasible and useful method
to correct the hazard would be to ensure the operator was trained in the
safe operation of the
dump trailer and was able to recognize hazardous situations with the load
and/or environmental
conditions and was able to correct them before an accident were to occur.
For example, daily
checks of the vehicle need to be completed prior to use to ensure no
damage or safety problems
exist, verifying the ground where the operation was to be performed is
level, check load for
even displacement, and at the end of each day, the trailer should be
cleaned.
