Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to: caught in hazards. On March 29, 2011 and at times prior, helper employees operated mobile waste and recyclable collection compaction equipment without the job-specific helper safety training required by ANSI Z245.1 which would help them in recognizing hazards while performing waste collection duties and riding on steps of collection vehicles. Abatement: Among other methods, one feasible and acceptable method to correct the hazards would be to implement the requirements Waste Management's own "Operations and Safety Rules Book" that states in Rule 12.1 "driver must complete a 'Helper Safety Briefing and Checklist' whenever they have a new helper." The "Helper Safety Briefing and Checklist" requires "the checklist must be conducted on site with the system type of truck, physically reviewing equipment and demonstrating elements of safe operation."
