Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to falls of approximately 20 feet when a fiberglass extension ladder, Werner Model 7124-2, was used to climb a power pole in the right of way behind 10 Conte Drive, Pittsfield, Massachusetts on April 15, 2011. The ladder used on the power pole had a standard top rung and no v-rung which is designed to prevent sliding of the ladder during climbing operations. The employee climbed the extension ladder while wearing pole climbing gaffs which do not provide a non-slip surface while on the ladder and the employee climbed from the top rung of the ladder onto the pole. Among other methods, one feasible and acceptable abatement methods to correct this harzard would be to have the employee climb the pole using gaffs and a climbing belt. Another acceptable method to correct this hazard would be to have the employee work from an insulated bucket elevated from a truck.
