Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being crushed by scrap or by a part of the
equipment:
On May 11, 2009, an employee was injured by scrap metal projecting from
and/or ejected from
the grapple of the Caterpillar 321B LCR Excavator after entering the
immediate surrounding
area which was not blocked off or guarded to prevent accidental entry into
the area.
Feasible means to abate this hazard include, but are not limited to, the
following:
1.Development, implementation and enforcement of workplace safety policies
for
operations in the yard, including, at a minimum, keeping other employees
away from the
hydraulic excavator when it is operating and/or prohibiting the operation
of the hydraulic
excavator when there is a need for other employees to be on foot
performing job duties
in the yard.
2.Guarding the area surrounding the hydraulic excavator with a barrier
guard in such a way
that it prevents the entry of workers into the radius of the swing of the
boom and grapple
plus the longest scrap extended from the grapple.
3.Training all operators of the hydraulic excavator to be sure that the
load in the lifting
device, e.g. grapple, is well secured and properly balance before it is
lifted more that a
few inches.
