North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish employment and a place of
employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to fire and explosion hazards:
a)process building, screw conveyors use to transport inedible bakery waste
and
midds were not equipped with equipment to control deflagration hazards.
b)process building, the inside bucket elevators used to inedible bakery
waste were
not provided with equipment to control deflagration hazards.
One feasible and acceptable method to correct this hazard is to install
explosion
protection in accordance with National Fire Protection Association (NFPA)
654, Standard
for the Prevention of Fire and Dust Explosions from the Manufacturing,
Processing and
Handling of Combustible Dust Particulate Solids (2006), Chapters 7.10.1,
7.11.1
and
7.1.2.

a)process building, the paper collection system installed on the 5 Rotex
shaker
tables did not minimize the escape of fugitive dust during normal
operation.
b)process building, the 5 Rotex shaker tables were open-topped and not
maintained
and operated in a manner to minimize the escape of combustible dust during
normal operation.
Feasible and acceptable methods of abatement is to install continuous
suction to minimize
the escape of dust and to maintain and operate equipment in a manner to
minimize the
escape of dust in accordance with National Fire Protection Association
(NFPA) 654
Standard for the Prevention of Fire and Dust Explosions from the
Manufacturing,
Processing and Handling of Combustible Particulate Solids (2006), Chapters
8.1.1 and
8.2.1

Carolina:  The employer did not furnish employment and a place of

serious physical harm
to employees in that employees were exposed to struck-by/caught-in between
hazards:
a)processing building, on April 18, 2009, an employee performing blow-down
was
observed working in a personnel basket attached to the forks of a Yale
forklift.
The personnel basket was not provided with overhead protection and the
forklift
was moving with the basket raised in proximity to overhead obstructions
such as
screw conveyors and metal conduit.  The employee in the basket was observed
ducking underneath a run of conduit as the forklift was being driven,
exposing
him to a struck-by or caught-in between hazard.
One feasible method of abatement is to follow the manufacturer's operating
procedures regarding
the lifting personnel and "Do not travel with people in the platform."
