North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: a)job site- where an employee was observed riding on the outside of the cab of a Ford F-650 dump truck (licence plate: AC-8098) while standing on the step below the drivers door and holding on to the rear-view mirror and the climb assist handle. ABATEMENT NOTE: One feasible abatement, among others, would be to re-train employees in proper vehicle operation and to require employees to wear seatbelts inside the truck cab between stops. (Reference: F-650 Owner Guide, Seating and Safety Restraints: "WARNING: It is extremely dangerous to ride in a cargo area inside or outside the vehicle. In a collision, people riding in these areas are more likely to be seriously injured or killed. Do not allow people to ride in any area of your vehicle that is not equipped with seats and safety belts. Be sure everyone in your vehicle is in a seat and using a safety belt properly.")
