North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish to each of his employees  conditions of
employment and a place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees, in
that employees were exposed to crushing injuries:
a)facility, service bay #1 - for employees required to operate a
full-rise, automotive
electric/hydraulic scissor lift, make and model unknown that was not
inspected on a routine
basis for excessive wear and damage such as, uneven lift, and build up of
oily grime, debris
and dirt.
One feasible abatement method, among others, to correct this hazard are,
but not limited to:
a)Perform daily inspections of the pads and adapters for damage or
excessive wear,
check latch release handle on lift for damage or binding and replace as
required.
b)Perform weekly inspections on all lift parts for signs of damage due to
overloading and
rough handling.
c)Perform monthly maintenance to include lubricating cylinder/locking leg
bolt, locking
leg release handle pivot, and lightly grease adapter sliding surfaces.
d)Perform semi-annual inspection of fluid level, hoses and seals.

a)facility, service bays - where employees were being exposed to vehicles
on Matco, model #
MFJ35B, 3.5-ton hydraulic service floor jacks, the employer did not
require the load of the
vehicles to be supported with jack stands to prevent dropping of the
vehicle load.
One feasible abatement method to correct this hazard is to place rated
jack stands under the
vehicle axle immediately after the load is lifted.

vehicles on Matco,
Model # MFJ35B, 3.5-ton hydraulic service jacks, the employer did not
require the wheels of
the vehicles to be chocked to prevent vehicles from movement and shifting
off the jacks.
One feasible abatement method to correct this hazard is to chock each
unlifted
wheel in both
directions.
