North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees in
that employees were exposed to the hazard of potential fire and explosion
because fixed bulk storage units and
air material separators (dust collectors) were not designed to minimize
damage that would occur in the event
of a dust explosion inside the machines:
a)facility, production, building 1 - 2 enclosureless and 1 cyclone wood
dust collection systems
were located inside the building.  The production area, a Class II,
Division 2 location, was
over 5,000 SF in size and the sum of fan motors created an aggregate air
flow of 12,500
CFM.
b)facility, production, building 2 - 5 enclosureless and 1 cyclone wood
dust
collection systems
were located inside the building.  The production area, a Class II,
Division 2 location, was
over 5,000 SF in size and the sum of the fan motors created an aggregate
air flow of 20,500
CFM.
c)facility, production - a documented housekeeping and inspection program
was not developed
and maintained to ensure the daily removal of wood dust from the buildings.
ABATEMENT NOTE:
1)Among other methods, one feasible and acceptable abatement method to
correct these hazards
is to relocate the dust collectors to the outside of the building.
2)Have the cyclone dust collection systems engineered, designed, and
located to meet all the
requirements listed in NFPA 664, Chapter 8.2.2.5.1.4 (1-6) or  have the
enclosureless dust
collection systems engineered, designed, and located to meet all the
requirements listed in
Chapter 8.2.2.5.1.4 (7).
3.)Develop a written housekeeping program in accordance with NFPA 664,
Chapter 11.1.2,
which meets the clean up program requirements of Chapter 11.2.1.1 and
11.2.1.2.
