North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: Struck by hazards from steel pipe pilings falling from the rigging while being lifted and moved during bridge construction. a)Job site - where rigging for a 24"diameter, 33'long pipe pile was not checked to ensure it was correct and secure prior to lifting the pipe. One feasible means of abatement is to ensure that the supervisor and employees act in accordance with ASME B30.5-2000 Section 5-3.2.1.4 (a)(2) The load is well secured and balanced in the sling or lifting device before it is lifted more than a few inches.
