North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free from
recognized hazards that were causing or likely to cause death or serious
physical harm to employees in that
employees were exposed to crushing injuries while working under a load
supported by the loader.
a)facility, outside shop - employees were exposed to crushing injuries
while working beneath cars
supported by the forks of the tool carrier, a multi-function machine used
in this operation with
forks attached to the front of the machine.
ABATEMENT NOTE:
1.)Among other methods, one feasible and acceptable abatement method would
be to obtain the
operators manual from the machine manufacturer which would indicate how to
safely operate,
and work near the equipment being used.

employees were exposed to vehicular accidents caused by operating the
loader without machine specific
training.
a)facility, outside shop - employees operating the Caterpillar Model IT28B
tool carrier were not
qualified by training to safely operate the machine.
ABATEMENT NOTE:

operators manual from the machine manufacturer which would indicate how to
safely operate,
and work near the equipment being used.
