Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees in
that employees were exposed to: Struck by hazards associated with partial
building collapse
a)Main warehouse - the mezzanine structure on the east wall designed to
store old business
records has sufferd repeated strikes from material handling equipment and
was no longer
structurally sound.
b)Trim shed - the south wall had fallen off its foundation wall that had
caused the roof structure
to sag; the exterior sheathing had rotted to the point that pieces of wood
had fallen off and the
exterior light fixture was near collapse.
c)Interior door frame warehouse - the roof structure was rotting in an
area adjacent to a wall that
had been  pushed off its foundation by forklifts and material to the point
that the exterior wall
was no longer supporting the roof.
Abatement note: One means of abatement would be to close the area from
employee exposure until
the space was evaluated by a structural engineer in order to develop a
repair plan and to execute that
plan.
