North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls to lower level: a) establishment, warehouse - where the employer did not provide a safe means of access to prevent employees from climbing on the storage racks to access the 2nd (5' 8" above floor level), 3rd (11' 6" above floor level), and 4th (17' 4" above floor level) tiers of storage racks. Abatement Note: One feasible and acceptable method, among others, to correct this hazard is provide scissors lifts or aerial lifts for employees to use to access the storage racks.
