North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that in that employees were exposed to thrown against, struck by and crushed by Roll Over Protection System (ROPS) hazard during tip-over: a)establishment, outside near automotive service center - for an employee observed operating Komatsu Forklift (Model # FG 25T-16, Serial # 213543A, Type GLP) without wearing the installed seat belt during operation. One feasible and acceptable abatement method, among others, to correct this hazard is to have operators fasten the seat belt while operating equipment. (Reference: ASME B56-1-1993, Paragraph5.3.19: An active operator protection device or system, when provided, shall be used.)
