Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free from
recognized hazards that were causing or likely to cause death or serious
physical harm to employees in that
employees were exposed to being struck by a falling vehicle:
a) establishment, automotive shop, bay 1 - where the employer did not
implement or maintain
periodic inspections for a 4 post Ben Pearson Automotive Lift (Model LMT
9).  There was a
safety latch on each of the 4 posts.  Employees were using the lift with
only 1 of the 4 safety
latches operating.

Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free from
recognized hazards that were causing or likely to cause death or serious
physical harm to employees in that
employees were exposed to being struck by a falling vehicle:
a) establishment, automotive shop, bay 1 - where the employer modified a 4
post Ben Pearson
Automotive Lift (Model LMT 9) without the express written consent of the
manufacturer.
Employees were using the lift with a pair of  "vice-grips" attached the
spring mechanism of the
front left safety latch, preventing it from engaging.
