Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and struck-by hazards: (a) Location - Yard: On or about 5/22/09, employees were exposed to crushing and struck-by hazards from walking in the fall zone while assisting in the transportation and delivery of granite slabs. Among other methods, one feasible and acceptable means to correct this hazard is to properly train workers on the safe handling of granite slabs. This includes but is not limited to: developing concise protocols for stone handling and transportation; prohibiting the use of hand guiding stone slabs as they are moved with a fork truck; attaching a tag line to maintain a safe distance while guiding slabs in transit.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing injuries: (a) Location - Shop: On or about 5/5/09, the employer failed to ensure that overhead cranes and hoists had been inspected on a frequent and periodic basis. Among other methods, a feasible and acceptable method to correct this hazard is to train employees to inspect the crane and hoist in accordance with the most applicable version of ASME B30. Additionally, retain a qualified person to inspect the crane and hoist on an annual basis in accordance with the most applicable version of ASME B30.
