North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) being thrown from the seat of a powered industrial truck (PIT) in the event of PIT being upset or turned over. Employees were not wearing the seat belt provided. One feasible and acceptable method of abatement, among others, would be to properly train all PIT operators in the use of seat belts and to require seat belts to be worn whenever they are operating a PIT equipped with an overhead guard. The exposed employees were not wearing seatbelts and the PIT was equipped with overhead protection. Reference: ASME B56.1-2004 - Safety Standards for Low Lift and High Lift Trucks, Section 5.3.19.
