Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being thrown from the cab of the forklift. (a)Establishment: On or about July 27, 2009, and at times prior thereto, employee(s) operate a powered industrial trucks without utilizing the seatbelt. Note(1): Among other methods, one feasible and acceptable abatement method to correct this hazard is to require the use of seatbelts when operating forklifts (Powered Industrial Trucks) throughout the establishment as required by ANSI/ASME B56.1, Paragraph 5.3.19. Note(2): Abatement certification and documentation IS required for this item.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and/or crushing hazards: (a)Main Mechanic Shop: On or about July 27, 2009, and at times prior thereto, employees were not provide with a platform attached to a forklift designed to lift personnel. Employee(s) rode up/down on the forks of a forklift with motorsport equipment, such as but not limited to snowmobiles, in an effort to stabilize the equipment from potential displacement, thus being exposed to fall and/or crushing hazards. Note(1): Among other methods, one feasible and acceptable abatement method to correct this hazard is to require a properly designed platform with guardrailing and/or other adequate fall protection in place to prevent employees from a fall to lower levels as required by Safety Standard for Manlifts, ASME A90.1-1969 and Safety Standard for Powered Industrial Trucks ANSI/ASME B56.1-1969. Note(2): Abatement certification and documentation IS required for this item.
