Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling from/being ran over by a rubber tired backhoe/loader while riding in the loader bucket: a)Inside lane of I-84 east, King Hill to Bliss Exit; On or about 8/25/09 and at times prior thereto, two employees were riding in the loader bucket of a rubber tired backhoe/loader while traveling from one area of the project to another. Note 1: Abatement certification is NOT required for this item. Note 2: Among other methods, a feasible and acceptable abatement method to correct this hazard would be to follow the manufacturer's Operating Manual or the Equipment Manufacturers Institute's (EMI) Safety Manual for Backhoe/Loader operators and mechanics, both of which prohibit any riders beyond the operator.
