Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to fall hazards from improper ladder use:
(a) On or about September 25, 2009, and at times prior thereto, a
maintenance
worker replacing lighting for the electric sign was standing on the top
plate of a 6
foot fiberglass A-frame self-supporting ladder located in an elevated
planter exposing
the employee to a 7.5 to 8 feet high fall hazard to the pavement below.
One feasible and acceptable abatement method, among others, to correct
this hazard is to
provide and require the use of a taller A-frame or extension ladder.  If
another A-Frame
ladder is used, comply with the manufacturer's instructions and ANSI 14.5
for Ladders -
Portable reinforced plastic - safety requirements, which states that the
user
shall not step or
stand on a ladder  top cap and the top step of a step or trestle ladder.
NOTE: Abatement certification is NOT required for this item.
