Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by approaching/passing traffic: a)Eastbound lane of Irving Road, East of Orchard Road, center of lane 20 feet east of crosswalk; On or about 12/29/09 and at times prior thereto, an employee without high visibility clothing/vest was on his knees in the middle of an active traffic lane while chiseling the cover for a gas valve out from under the asphalt. Note: Abatement certification is NOT required for this item.
