Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to the employees in that employees were exposed to the hazard of being thrown out of the cab of a rough terrain forklift truck while operating the machine beyond its rated capacity and outside of its intended use: a)Jobsite: On June 30, 2010 and times prior thereto, the operator of a Manitou forklift truck (MT 6642XT) exceeded the rated load capacity, and used the machine for demolition activities in a manner in which the manufacturer did not design or intend the machine to be used. The forklift truck was used to demolish a two-story brick veneer building and break up the resulting debris pile, causing the machine's wheels to lift off the ground and the fully extended boom to bow under the forces imposed on it. Note: Abatement certification and documentation are required for this item.
