Section 5(a)(1) of the Occupational Safety and Health Act: The employer
did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees
were exposed to the potential hazard of fire and explosion in the Provon
Dryer:
a.)On or about July 12, 2010, and at times prior thereto, the Provon dryer
with a
potential dust explosion hazard, was not equipped with explosion relief
venting.
Among other methods, feasible and acceptable means of abatement would be
to provide
explosion relief venting to the Provon Dryer in accordance with the
National Fire Protection
Association NFPA 61, standard for the Prevention of Fires and Dust
Explosions in
Agricultural and Food Processing Facilities, Chapter 6, Explosion
Prevention, Relief, and
Venting.
