Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being thrown from the forklift: (a)On or about July 13, 2010, and at times prior thereto, the employer did not instruct on and/or enforce the utilization of the seat belts by operator(s) of the Rough Terrain Forklift. Note(1): Abatement certification IS NOT required for this item. Note(2): Amongst other methods, several feasible and acceptable methods to correct this hazard is by complying with the manufacturer's operation guide regarding use of the manufacturer supplied seatbelt and/or QNWI/ITSDF B56.1-2005 (Reaffirmation of ASME B56-2004), Section 7.41, Operator Restraint Systems.
