Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to fall hazards:
(a)White staircase providing access to 2nd level: On or about September 24,
2010, and at times prior thereto, Corral Agriculture, Inc., exposed
employees
to fall hazards on a flight of stairs having thirteen risers that was not
equipped
with a midrail .
(b)Top of white staircase,  Left & Right side: On or about September 24,
2010,
and at times prior thereto, Corral Agriculture, Inc., exposed employees to
fall
hazards while they accessed planks positioned against the north wall and
utilized them as a walking working surface, thus being exposed to an
approximate 8 foot fall to the surface below.
(c)Incline walkway next to roller(s) on the second level: On or about
September
24, 2010, and at times prior thereto, Corral Agriculture, Inc., exposed
employees to a fall hazard of approximately 10-15 feet while accessing an
incline walkway that was not equipped with top rail, midrail, and/or posts.
(d)East platform. level 2.5: On or about September 24, 2010, and at times
prior
thereto, Corral Agriculture, Inc., exposed employees to an approximate
15-20
foot fall hazards when they accessed a platform that was not equipped with
a
top rail and the midrail measured at 28 inches from the platform.
(e)Metal stairs up to walkway from shaker 2.5 level: On or about September
24,
2010, and at times prior thereto, Corral Agriculture, Inc. exposed
employees
to an approximate 20 foot fall hazard while utilizing the stairs to access
the
third level with one unprotected side.
(f)Plank above the shaker on the east side: On or about September 24,
2010, and
at times prior thereto, Corral Agriculture, Inc. exposed employees to an
approximate 19 foot fall hazard when employees utilized a 9 1/2 inch plank
as
a walking working platform.
(g)Metal stair risers accessing level 3:  On or about September 24, 2010,
and at
times prior thereto, Corral Agriculture, Inc. exposed employees to a fall
hazards to the surface below when utilizing the stairs missing the
midrails on
both sides of the risers.
(h)Top of grizzly "vineway": On or about September 24, 2010, and at times
prior
thereto, Corral Agriculture, Inc. exposed employees to a fall hazards to
the
surface below while they accessed the walkway that was missing the midrails
on both sides of the walkway.
(i)Above the grizzly, west side of building: On or about September 24,
2010,
and at times prior thereto, Corral Agriculture, Inc. exposed employees to
an
approximate 20 foot fall hazard from the 3rd level walkway which ran north
to
south that was missing the midrails.
(j)Outside unloading area near red guide vineway feeder into the grizzly:
On or
about September 24, 2010, and at times prior thereto, Corral Agriculture,
Inc.
exposed employees to fall hazards of approximately 20-25 feet to the
surface
below when they accessed the outside unloading area that was missing the
midrails.
(k)Dryer/Bailing Building: On or about September 24, 2010, and at times
prior
thereto, Corral Agriculture, Inc. exposed employees to a fall hazards when
they utilized stair risers to gain access to the second level that was not
equipped with a top and/or midrail.
(l)Dryer/Bailing Building, 2nd floor level: On or about September 24,
2010, and
at times prior thereto, Corral Agriculture, Inc. exposed employees to an
approximate 15-17 foot fall hazard when employees accessed the 2nd level of
the structure that was missing the midrails.
Abatement Note (1): Among others, one feasible and acceptable abatement
method to correct
this hazard is to comply with the requirements of ANSI A1264.1-2007 Safety
Standards for
Workplace Walking/Working Surfaces and Their Access; Workplace Floor, Wall
and Roof
Openings: Stairs and Guardrail Systems to ensure that each open-sided
floor and platform is
equipped with standard railing to prevent employees from falling from
elevations.
Abatement Note (2): Abatement certification and documentation ARE required
for this item.
