Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were likely to cause death or serious physical harm to the employees
exposed to falling
and crushing hazards relating to underhung hoist operations:
a)Warehouse: On or about October 29, 2010 and times prior thereto while
moving furniture, employees were lifted and lowered between floors on a
platform attached to the Chester Electric Hoist.  This hoist is not
designed to
safely lift, support, or otherwise transport people.
b)Warehouse: On or about October 29, 2010 and times prior thereto the
Chester
Electric Hoist was used to transport employees and furniture with a  wire
rope
that was worn and damaged.
Modified in accordance with Informal Settlement Agreement Dated December
30, 2010.
a)Warehouse: The Chester Electric Hoist used to move furniture was not
inspected on a periodic basis.
b)Warehouse: The Chester Electric Hoist used to lift furniture was not
posted
with a sign that prohibited employees froom riding on the hoist.
Note 1) Feasible and acceptable abatement for this hazard may include, but
is not limited to:
a) Develop, implement, and enforce safe work practices for use of the lift
assembly.  This
must include written guidance on acceptable use of the lift assembly, load
limits, and
prominently posted warning signs.  The hoist must be used in accordance
with the
manufacture's instructions.
b) Develop and implement an inspection and preventative maintenance
program based on the
frequency and severity of use as determined by a qualified person familiar
with
the process.
