Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by vehicular traffic: On or about 7/15/09 at mile marker 29, Route 80 East, Mount Arlington, NJ, an employee was exposed to being struck by vehicles while standing in the middle traffic lane holding a sheet of plywood perpendicular to the road way surface to prevent sand blast grit from striking passing cars & trucks. Among other methods, one feasible & acceptable method to correct this hazard would be to fabricate a panel which can be held in place from the interior of the work zone eliminating employees from standing in traffic and being exposed to being struck by oncoming vehicles.
