Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees, in that,
employees were exposed to the hazard of being struck/crush by the bucket
of the excavator.
a) At the site; the excavator arm and bucket was swung over the heads of
workers in
the excavation.
Page 17 of the Safety Manual for Users, Operators and Maintenance
Personnel for a
Hydraulic Excavator published by The Construction Industry Manufacturers
Association (CIMA) warns that the operator should never allow personnel to
walk or
work under any part of the machine or load while the machine is operating.
Among other methods, feasible and acceptable methods to correct this
hazard are:
1. Implement a safety policy that instructs employees on how to avoid
working within
the swing radius of the excavator arm/bucket.
2. Keep workers outside the excavator swing areas and do not allow workers
to stand
under suspended loads or suspended machine components such as the boom,
arm or
bucket.
3. Train employees to recognize and avoid unsafe conditions and to follow
required
safe work practices that apply to their work environments.
4. Use spotters or signal persons around operating equipment when
necessary.
