Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or physical harm to employees in
that employees were
exposed to:
Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico:
El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a:
At Dr Modesto Rivera School in Carolina PR, teachers were exposed to
verbal, psychological
and physical aggressions inflicted by student parents.  It was documented
that on January 21,
2010 a teacher was physical attacked by a student mother in the
administrative office of the
school.
Hazard: Employees were exposed to workplace violence.
Among other methods, one feasible and acceptable method to correct this
hazard is to establish
and implement a written protocol to handle work place violence and provide
training to all the

En la escuela Dr. Modesto Rivera en Carolina PR, maestros estuvieron
expuestos a agresiones
verbales, psicologicas y fisicas causadas por padres de estudiantes.  Se
documento que el 21 de
enero de 2010 una maestra fue atacada fisicamente por la madre de un
estudiante en las oficinas
administrativas de la escuela.
Riesgo: Empleados estaban expuestos a la violencia en el trabajo.
Entre otros metodos, un metodo factible y aceptable para corregir este
riesgo es establecer e
implantar un protocolo escrito para el manejo de la violencia en el lugar
de trabajo y proveer
adiestramiento a todos los empleados.  La informacion esta disponible en

Domestic Violence Situation in the Workplace or Place of Employment Act
No. 217 of
september 29, 2006.
Hazard: Employees were exposed to domestic Violence in the worplace.
One method among others to abate this hazard: develop a written protocol
to handle
domestic violence in the workplace and provide training to all the
employees, for have
knowledge and act if this situation is presented. The Women's Advocate
Office will
provide to the employer the necessary technical guidance for
implementation of the
protocol.
En la Escuela Dr. Modesto Rivera Rivera, los maestros fueron expuestos a
lesiones
y
enfermadades debido a que el patrono no tenia un protocolo escrito de
violencia
domestica en el lugar de trabajo, requerido bajo la Ley para la
Implementacion del
Protocolo de Situaciones de Violencia Domestica en el Lugar de Trabajo o
Sitio de
Empleo, Ley numero 217 del 29 de septiembre de 2006, y la Ley numero 16
del 5 de
agosto de 1975 segun enmendada.
Riesgo: Empleados estaban expuestos a Violencia Domestica en el lugar de
trabajo.
Un metodo para disminuir el riesgo: Desarrollar un protocolo escrito de
violencia
domestica en el lugar de trabajo y proveer adiestramiento a todos los
empleados, para
que tengan conocimiento y actuen en caso de que se presente esta
situacion. La Oficina
de la Procuradora de la Mujer provee al patrono las guias necesarias para
la
implementacion del protocolo.
