Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to employees exposed to crushing injuries in the event of an accident and/or equipment roll over when the provided seat belt was not utilized: (a)Tabler Station Connector, I-81 Median: On August 11, 2009 and times prior to, the provided seat belt was not worn by the operator of the Komatsu PC200LC excavator. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard includes, but not limited to; enforce employee usage of seat belts when operating earth moving equipment and follow the Komatsu owner's manual.
