Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause physical harm to employees in that an employees were exposed to the hazard of crushing injuries associated with the rollover of a lift truck without the use of an operator restraint system: (a)Facility Lot: On November 17th 2009 and times prior to, an employee operated a Hyster fork lift (model # H30XM) without the use of the installed seatbelt. One feasible and acceptable abatement method to correct this hazard is to follow ASME B56.1-1993 Safety Standard for Low and High Lift Trucks, which requires the usage of an operator restraint system at all times.
